Karen Cruz from Orlando Florida underwent a kidney transplant in 2007, which ultimately infected her with the HIV virus.
Karen Cruz who is 55, said Lee Memorial health system, six doctors and one of the country's largest testing laboratories did not properly screened the donor before the 2007 surgery. The donor who is a female relative of Karen's, was tested positive for HIV in one of the two test, along with the
Epstein-Barr virus and Cytomegalovirus, said Mark Glassman, one of Cruz's attorneys.
“while you have one positive and one negative test, what they decided to do was to rely on one test over the other without notification to the recipient that there had been this positive test,” Glassman said.
Now Epstein-Barr, can cause mononucleosis in young adults and CMV are viruses found in most adults and often do not cause illness, according to the U.S Centers for Disease control and Prevention.
Karen said she became ill around 2008 as a result of the CMV. She also was tested for HIV and Epstein-Barr antibodies, showing presence of the viruses in her system.
The Lee Memorial Health System was notified about the lawsuit Wednesday, and this what they had to say. “Despite the allegations in the complaint, services provided by the transplant center were appropriate and met standards of care,” said the systems spokeswoman Karen Krieger. “we defend this case on the merits.”
Once I heard this story I, couldn't help to speak about it. Has it really come to this?
Here's a profession were you're suppose to help take care of people, not just collect a healthy paycheck. Do we not live by this new saying “If you see something, say something”. Should it only be applied to acts of terrorism? If your a doctor and your about to do a transplant, and you understand that the blood your giving is no good, why would you still give it? It's just inhumane to me but, that's just me.
